Do I need a demolition permit?
A demolition permit is required for most buildings, except a class 10 building (shed, patio and the like) which does not exceed 40m2 in floor area and does not adversely affect other land. Buildings subject to the Heritage Act always require a demolition permit prior to commencement of works.

How to apply for a demolition permit
Lodge to the Shire a fully completed and signed “application for a demolition permit” (BA5) form which is available on BA5 – Application for demolition permit | Department of Energy, Mines, Industry Regulation and Safety (commerce.wa.gov.au)
The application must be accompanied by:
- Payment of the prescribed fee and levy (if applicable),
- A site plan, drawn to scale (preferrable min 1:200) and clearly showing the buildings to be demolished,
- A copy of any planning approvals under the Planning and Development Act 2005 where required,
- Written evidence of notifications of the intended work to the providers of electricity and gas services to the property,
- Where the property / buildings are subject to the Heritage Act, written clearance from the Heritage Council of Western Australia confirming that the proposed demolition would not be inconsistent with an order, agreement or permit under that Act,
- Written evidence of notifications required under the Work Health and Safety (General) Regulations 2022 and regulation 142F,
- Written evidence from a licensed pest control company confirming that the building has been treated (rat baiting) to ensure that it is not infested by rodents at the time of the demolition,
- Where asbestos is present, details of the licensed asbestos contractor, and
- Where the work may adversely affect other land, court orders or BA20 (notice and request for consent to encroach or adversely affect) forms which are available on BA20 – Notice and request for consent to encroach or adversely affect | Department of Energy, Mines, Industry Regulation and Safety (commerce.wa.gov.au)
Other approvals and requirements
Planning Services:
A Development Application and Planning Approval is required where the demolition work:
- is associated with heritage structures or fabric in a heritage – protected place,
- is for a boundary wall shared between 2 single houses/grouped/ multiple dwelling.

Environmental Health Services:
- Asbestos removal: A licenced asbestos contractor is required for the removal of friable asbestos and more than 10 square metres of non-friable asbestos.
- Decommissioning of a septic system: Only licensed and approved personnel can decommission septic tanks and should provide property owners with copies of receipts/photos of the decommissioning work.
- Pest control measures: A rat bate certificate from a licensed pest control company is required to be submitted with the demolition permit
- Dust and building waste: Dust and building waste control measures are to comply with the Shire’s Dust and Building Waste Local Law 2017.

Notices of Completion
Upon the completion of all works for which a demolition permit has been granted the nominated contractor(s) are required to provide the Shire within 7 days of the works being completed, a Notice of Completion, which is available on BA7 – Notice of completion | Department of Energy, Mines, Industry Regulation and Safety (commerce.wa.gov.au)
